1. Acceptance of Terms

By accessing or using Best Birthday Wishes (the "Service"), you agree to these Terms. If you do not agree, do not use the Service.

2. What the Service Does (and Does Not Do)

The Service provides curated birthday messages, templates, and related tools you can use to generate and download greeting content. We do not provide user accounts and we do not host or publish your generated output. Your use is on-demand; output is generated for your own use and not stored by us.

3. License to Use Service Content (Non-Commercial)

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service and the content we provide (including text suggestions, templates, and designs) solely for personal, non-commercial purposes. You may not redistribute, resell, or make systematic copies of our content, or use automated scraping or bulk downloading.

4. Your Generated Output

You are responsible for how you use any output you generate or download (including ensuring you have rights to any materials you combine it with). We do not store or publish your output. If you share your output elsewhere, you are solely responsible for that sharing.

5. Prohibited Uses

• Do not violate any law or third-party rights.
• Do not remove proprietary notices or claim our content as your own.
• Do not scrape, crawl, or use automated means except as allowed by robots.txt.
• Do not interfere with or bypass security or technical limitations.
• Do not reverse engineer the Service.

6. Third-Party Links and Tools

The Service may reference third-party resources. We do not control or endorse them and are not responsible for their content or availability.

7. Children

The Service is not directed to children under 13. If you are under the age required by your jurisdiction to consent (e.g., under 16 in the EU/UK), use the Service only with a parent or legal guardian's permission.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

We may modify or discontinue the Service in whole or in part. We may update these Terms; the "Last updated" date will change accordingly. Your continued use after changes become effective constitutes acceptance.

11. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. You and we agree to the exclusive jurisdiction and venue of the state and federal courts located in San Francisco, California.
